Terms of Service

These Terms of Service (“Terms”) govern your access to and use of CafeOS, the venue management platform operated at operate.cafe (“the Platform”). By creating an account, you agree to these Terms. Please read them carefully.

References to “you” mean the venue owner, manager, or staff member using the Platform. References to “we”, “us”, or “CafeOS” mean the operators of operate.cafe.

1. Account registration

  • You must provide accurate and complete information when registering an account. You are responsible for maintaining the confidentiality of your login credentials.
  • You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or the business you represent.
  • You are responsible for all activity that occurs under your account, including activity by staff members you invite to your venue.

2. Permitted use

  • CafeOS is a business tool for managing cafés, restaurants, hookah bars, and similar hospitality venues. You may use the Platform only for lawful business purposes.
  • You must comply with all applicable laws and regulations in the jurisdiction where you operate your venue, including food safety, employment, taxation, and consumer protection laws.
  • You may not use CafeOS to process payments for illegal goods or services.

3. Payments and fees

  • CafeOS is free to start. We charge a platform fee on each payment processed through Stripe Connect. The current fee is displayed during Stripe Connect onboarding and may be updated with notice.
  • You are responsible for any taxes applicable to payments you receive from customers. CafeOS does not collect or remit taxes on your behalf.
  • All customer payments are processed by Stripe. Your use of Stripe is subject to Stripe's Terms of Service and Connected Account Agreement. CafeOS is not responsible for Stripe outages, disputes, or chargebacks.
  • Stripe deposits (reservation deposits captured in advance) are subject to the same platform fee as standard transactions.

4. Your content

  • You retain ownership of all content you upload to CafeOS, including menu items, photos, and venue details.
  • By uploading content, you grant CafeOS a non-exclusive licence to store and display that content to your customers and staff as part of operating the service.
  • You are responsible for ensuring that your menu content, pricing, and promotions are accurate and comply with applicable consumer protection laws.

5. Customer data

  • As a venue using CafeOS, you act as a data controller for the personal data of your customers (e.g., reservation contact details, order emails). CafeOS acts as a data processor on your behalf.
  • You are responsible for ensuring you have a lawful basis to collect and use customer personal data, and for complying with applicable data protection laws (including GDPR where applicable).
  • You must have a privacy policy in place for your venue that covers your use of CafeOS to process customer data.

6. Service availability

  • We aim to provide a reliable platform but do not guarantee 100% uptime. Scheduled maintenance will be communicated in advance where possible.
  • CafeOS is provided “as is”. We make no warranties, express or implied, regarding the fitness of the Platform for any particular purpose.
  • We are not liable for any loss of revenue, orders, or data arising from Platform downtime, bugs, or service interruptions.

7. Limitation of liability

  • To the maximum extent permitted by law, CafeOS’s total liability to you for any claim arising from use of the Platform is limited to the amount of platform fees you paid in the 3 months preceding the claim.
  • CafeOS is not liable for indirect, incidental, or consequential damages, including lost revenue or data loss.

8. Termination

  • You may close your account at any time by contacting us at contact@operate.cafe.
  • We may suspend or terminate your account if you breach these Terms, use the Platform for illegal purposes, or engage in activity that damages CafeOS or other users.
  • On termination, your access to the Platform ceases. We will retain order and transaction records as required by financial regulations.

9. Changes to these Terms

  • We may update these Terms from time to time. We will notify you of material changes via email. Continued use of CafeOS after notification constitutes acceptance of the updated Terms.

10. Governing law

  • These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
